SmartATG is an Automated Tank Gauge (“ATG“) interrogator that enables direct querying of supported ATGs without additional hardware, VPNs, or firewall modifications. SmartATG presents fuel data either directly through the Mako Central Management System (CMS) web application or via API integration with existing systems. Automated ATG discovery allows Customers to identify and manage ATGs across multiple locations via the Mako System.
Any capitalized terms not defined herein shall have the meaning as set forth in the applicable Mako Networks Services Agreement with the Customer.
Service Requirements
SmartATG functionality requires a working internet connection for Mako Equipment, compatible ATG equipment with necessary connection ports, and proper network configuration and connectivity between Mako Equipment and ATG. A “working connection” means the Mako Equipment can successfully communicate with the ATG equipment using standard protocols and receive valid responses. Auto-detection requires that the ATG be properly configured and accessible on the network with appropriate ports open. Customer is responsible for maintaining these requirements throughout the service term.
Third-Party Data Disclaimer
SmartATG retrieves and processes data from third-party ATG equipment not manufactured or controlled by Mako. Mako does not warrant or guarantee the accuracy, reliability, completeness, or timeliness of any data obtained from ATG equipment. Data quality depends entirely on the condition, calibration, and functionality of Customer’s ATG equipment. Mako serves solely as a data conduit and not as a data validator or verifier. Mako has no ability to detect or correct errors in underlying ATG data. Customers should independently verify critical data before taking operational actions based on SmartATG information.
Equipment Compatibility
SmartATG uses proprietary auto-detection technology to identify and connect with various ATG models. While auto-detection works with many common ATG models, Mako cannot guarantee compatibility with all ATG equipment available. Compatibility depends on ATG make, model, firmware version, configuration, and network accessibility. Some ATG equipment may be partially compatible (limited functionality) rather than fully compatible. ATG firmware updates or configuration changes might affect compatibility and functionality after initial setup.
Implementation and Configuration
Customer is responsible for providing accurate information about their ATG equipment and environment. Automated ATG discovery requires Customer to ensure proper network connectivity and configuration. Standard implementation assumes standard network configurations and may require additional work for non-standard setups. Any custom configuration, troubleshooting, or implementation beyond standard setup may incur additional Non-Standard Work Charges (or charges related to out-of-scope work). Customer may be required to provide necessary access permissions and credentials for ATG systems. Implementation success depends on proper ATG functionality and network connectivity.
Service Limitations
SmartATG service depends on multiple factors outside Mako’s control: ATG equipment functionality, network connectivity, power availability, etc. Service performance can be affected by ATG maintenance, power outages, network issues, equipment failures, or firmware updates. Data collection may be interrupted or delayed due to these external factors. Mako bears no liability for any claims, losses, or damages related to ATG data accuracy, completeness, timeliness, or availability. SmartATG is a monitoring and data collection service, not a critical safety or emergency response system. Mako makes no representations about the frequency, latency, or consistency of data updates beyond reasonable efforts to query the ATG as configured.
Customer Responsibilities
Customer is responsible for maintaining all ATG equipment in proper working order per manufacturer specifications. Customer must promptly report any ATG issues that may affect data collection to both Mako and the ATG equipment provider. Customer is responsible for ensuring proper network connectivity between Mako Equipment and ATG systems. Customer must independently verify data accuracy before making critical business decisions. Customer should maintain appropriate backup systems and procedures for fuel inventory management. Customer must inform Mako of any changes to ATG equipment, configurations, or networks that might impact SmartATG functionality.
Data Ownership and Usage
Tank data collected through SmartATG belongs to the Customer but is processed and stored by Mako. Mako can use anonymized and aggregated data for service improvement, troubleshooting, and statistical analysis. Mako may share anonymized data with third parties for service improvement purposes.
Additional Warranty Exclusions
Mako explicitly excludes any warranty related to underlying ATG hardware functionality, accuracy, or reliability. Mako makes no warranty regarding the business decisions made based on SmartATG data. Mako disclaims any warranty related to fuel inventory management outcomes or decisions. SmartATG is provided “as is” without any guarantees regarding specific business outcomes. Mako does not warrant that SmartATG service will be uninterrupted, error-free, or completely secure. These exclusions are in addition to the warranty limitations in the main agreement.
Service Testing and Verification Process
Upon installation, Customer may verify proper functionality by checking data flow from ATG to Mako CMS. Successful implementation is defined as the Mako System’s ability to detect and retrieve basic information from the ATG. Customer should verify data accuracy by comparing Mako CMS readings with physical ATG readings. Basic troubleshooting includes checking network connectivity, ATG power, and proper physical connections. Customer should report functionality issues to Mako support via email at support@makonetworks.com.
Disclaimer of Regulatory Compliance
While SmartATG may help facilitate compliance activities, Mako makes no guarantees regarding regulatory compliance. Customer remains solely responsible for regulatory compliance related to fuel storage, environmental monitoring, and reporting. Mako is not responsible for ensuring data collected meets regulatory standards or reporting requirements. Customer should consult with regulatory experts regarding compliance requirements.
