Periscope Terms

Periscope is a feature of the Mako Central Management System (CMS) that provides secure access to web-based services hosted behind Mako devices at remote sites.

Any capitalized terms not defined herein shall have the meaning as set forth in the applicable Mako Networks Services Agreement with the Customer.

Service Requirements

Periscope functionality requires a Mako 6600-M security gateway or newer. Users must have appropriate access credentials to the Mako CMS and be authorized to view or manage Periscope services. Multi-factor authentication (MFA) must be enabled for all users accessing Periscope services. A properly configured network environment and appropriate user permissions for both the Mako CMS and target systems are necessary for successful operation.

Customer Responsibilities

Customer is solely responsible for all actions taken through Periscope, including but not limited to any changes made to POS systems, CCTV, DVRs, IoT devices, network storage, and any other devices accessed through Periscope. Customer acknowledges that improper use of Periscope may result in damage to or malfunction of Customer’s systems or devices, for which Mako bears no responsibility. Customer is responsible for ensuring that all users authorized to access Periscope have appropriate training and knowledge to properly use the systems being accessed. Customer shall ensure that all use of Periscope complies with applicable laws, regulations, and industry standards.

Third-Party Systems Disclaimer

Periscope provides access to third-party systems and devices not manufactured or controlled by Mako. Mako does not warrant or guarantee the functionality, performance, security, or reliability of any third-party systems accessed through Periscope. Mako serves solely as an access conduit and not as a system controller or manager. Mako has no ability to detect or correct errors in underlying third-party systems. Customers should exercise caution when making changes to critical operational systems accessed through Periscope.

Limitation of Liability

Mako provides Periscope as an access method only and makes no representations or warranties regarding the functionality, security, or reliability of any third-party systems accessed through Periscope. Mako shall not be liable for any damages, losses, or expenses arising from Customer’s use of Periscope to access, modify, or interact with any systems or devices behind the Mako device. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAKO DISCLAIMS ALL LIABILITY FOR ANY DATA LOSS, SYSTEM DAMAGE, BUSINESS INTERRUPTION, OR OTHER DAMAGES RESULTING FROM CUSTOMER’S USE OF PERISCOPE.

Service Limitations

Periscope service depends on multiple factors including network connectivity, power availability, and third-party system functionality. Service performance can be affected by system maintenance, power outages, network issues, equipment failures, or firmware updates. Access may be interrupted or delayed due to these external factors. Periscope is a remote access service, not a critical safety or emergency response system. Mako makes no representations about the availability or performance of third-party systems accessed through Periscope.

Implementation and Configuration

Customer is responsible for providing accurate information about their network environment and systems. Standard implementation assumes standard network configurations and may require additional work for non-standard setups. Any custom configuration, troubleshooting, or implementation beyond standard setup may incur additional Non-Standard Work Charges. Customer may be required to provide necessary access permissions and credentials for third-party systems. Implementation success depends on proper system functionality and network connectivity.

Service Testing and Verification Process

Upon implementation, Customer may verify proper functionality by accessing target systems through the Periscope interface. Successful implementation is defined as the ability to access target systems through the Mako CMS. Customer should report functionality issues to Mako support via email at support@makonetworks.com.

Support and Maintenance

Mako will provide technical support for Periscope itself but not for any third-party systems accessed through Periscope. Support for third-party systems must be obtained from the respective vendors or service providers. Mako may perform periodic maintenance to Periscope, which could result in temporary service interruptions. When possible, Mako will provide advance notice of scheduled maintenance.

Data Protection

Customer acknowledges that any data transmitted through or accessed via Periscope may be subject to applicable data protection laws and regulations. Customer is responsible for ensuring that its use of Periscope complies with all applicable data privacy and security requirements, including but not limited to those governing personal information, payment card data, and health information.

Modifications

Mako reserves the right to modify these Periscope Terms at any time by providing notice to Customer. Customer’s continued use of Periscope following any modifications constitutes acceptance of the modified Periscope Terms.
