This Mako Voice Services Addendum supplements and becomes part of the existing Services Agreement between Mako Networks, Inc. (“Mako“) and Customer upon the addition of Voice Services to Customer’s account. The terms and conditions set forth in the Services Agreement remain in full force and effect, except as modified or supplemented by this Addendum. In the event of any conflict between the terms of this Addendum and the Services Agreement, the terms of this Addendum shall control with respect to Voice Services only.

By adding Voice Services to your Services Agreement, Customer agrees to comply with and be bound by the following additional terms and policies:

Service Information
Calling Area: Voice Services are only offered and supported in the United States with unencumbered high-speed internet connections. Mako does not guarantee functionality if used outside its service area or with ISP-restricted VoIP services. Customer bears sole responsibility for compliance with all laws when using or transporting devices internationally. Calls within the United States exclude international calls, U.S. territories, Canada, premium services (411), and operator-assisted calls (0+).
Service Limitations: Continued Voice Services require an active high-speed internet connection. Mako does not support operator-assisted calling, collect calls, or third-party billing, and may not support certain x11 services (311, 511) in some areas. Mako may block or charge for calls resulting in atypical costs, including “free” conferencing services, chat services, or 900 numbers.
Certain Incompatible Services: Customer acknowledges that Voice Services may not be compatible with all non-voice communications equipment, including but not limited to security systems, TTY, medical monitoring equipment, satellite television systems, PBX, Centrex, other private telephone networks, or computer modems. Customer waives any claim against Mako for interference with or disruption of Voice Services and any claim that Mako is responsible for any disruption to Customer’s business, if applicable. Some broadband service providers may provide modems that prevent the transmission of communications using Voice Services. Mako does not warrant that Voice Services will be compatible with all broadband services and expressly disclaims any express or implied warranties regarding the compatibility of Voice Services with any particular broadband service.
Toll Free Calling: If Customer uses Mako’s “Toll-Free” feature, additional charges may apply for toll-free calls made to Customer’s number.
Taxes: All rates, fees, and charges are exclusive of applicable taxes, for which Customer is solely responsible. Taxes may vary based on jurisdiction and the Services provided. Taxes, access fees, universal service or other recovery fees, or similar charges will be adjusted on the date on which those increases become effective as mandated by a competent authority.
Definitions
“Customer” means the person or other legal entity using Mako Services or Mako Equipment, being a person or other legal entity contractually engaged with Mako.
“Mako Equipment” means the hardware device (or devices) supplied to Customer by Mako that enables Customer to access the Mako Services, including any software installed on such devices.
“Mako Services” means the network, applications, reporting, support, or other services Customer has requested to use under license from Mako and which Mako agrees to supply via Mako Equipment and any other means Mako makes available to enable the provision of those services to Customer.
“Services Agreement” means any agreement between Mako and Customer governing the provision of Mako Services, including but not limited to service orders, statements of work, or other written agreements.
“Voice Services” means the voice over internet protocol (VoIP) services provided by Mako, including but not limited to voice calling, voicemail, and related telephony features.
