Mako Voice Numbering Policy

Use of voice services provided by Mako Networks, Inc., and its subsidiaries (“Mako“) are subject to this Numbering Policy. As used herein, “Customer” means any person or entity that purchases or subscribes to Mako’s voice services. This Numbering Policy is incorporated into and made a part of the Agreement.

I. Number Availability

Mako provides phone numbers for voice services, which Customer may select for assignment to their Account. Mako’s listing of a number as available does not constitute a representation or guarantee that such a number is available for such assignment.
Numbers assigned by Mako will not be listed in any telephone directories. For numbers ported to Mako that were previously listed in telephone directories, existing listings may continue, but Mako assumes no control over or responsibility for such listings.

II. Number Porting

Porting Numbers to Mako (Port-In)

Customer must keep their existing service active to port a phone number to Mako. To initiate a port-in, which is provided at no additional charge, the Customer must contact Mako Support, complete all required steps, and provide all requested information, including an executed Letter of Agency if required. Most existing numbers can be ported to Mako. Mako cannot guarantee that all numbers are available to be ported until the existing vendor approves the port out request.

Porting Numbers Away from Mako (Port-Out)

Customer may port any number assigned to their Mako account to another provider for a fee of $6.00 USD per number. Upon receiving notification of successful port-out completion to another provider, Mako may terminate service for that number immediately. Customer remains responsible for all charges and fees through the end of the contractual term. Mako cannot guarantee that a new provider will be able to accept or port Customer’s numbers.

Porting Requirements and Restrictions

The porting process requires the Customer’s cooperation to ensure compliance with law and industry standards. Completion timeframes are estimates only and depend on various factors outside Mako’s control, including delays caused by Customer or other service providers.

Unauthorized Port-Outs

Mako is required by law to comply with any valid porting request. Phone numbers may be ported out from an account due to third-party actions, and Mako may be unable to prevent port-outs or retrieve ported numbers or port numbers back into Customer’s Mako account. Mako bears no responsibility or liability for such port-outs.

Accurate Porting Information

Customer represents and warrants that all information provided for porting numbers to or from Mako will be true, accurate, and up to date.

Customer Compliance with Porting Laws

The porting of numbers is subject to telecommunications and other laws and may be subject to third-party terms and conditions. Customer, and/or any party acting on Customer’s behalf, shall not: (i) violate any applicable law or engage in any fraudulent or deceptive conduct in its porting-related requests or activities; (ii) engage in or facilitate “slamming” (the illegal practice of switching a traditional wireline telephone company for local, local toll, or long distance service without permission) or the porting out of any telephone number or change or attempt to change any party’s telephone service provider without first obtaining the proper, requisite consents and authorizations; or (iii) violate contractual or other obligations to service providers or other third parties.

Release of Numbers

Upon account termination or cancellation, all telephone numbers associated with Customer’s Mako account that have not been successfully ported may be released and become available to other customers, subject to applicable law. Customer may port out or cancel any assigned number at their discretion and is solely responsible for coordinating with their new provider to port numbers before termination of their Mako services.

III. Number Publication by Customer

All new number assignments are provisional until verified by Mako and confirmed by Customer. Customer shall not publicize, list, or communicate any number assigned to Customer’s Mako account and shall not purchase or invest in any materials or media reflecting any such number unless and until Customer has confirmed that each such number is active and functioning as desired.
