Mako Networks, Inc., and its subsidiaries (“Mako“) trademarks, logos, brand elements, and other works of authorship eligible for copyright protection (collectively, the “Mako Marks“) are valuable assets that represent our company’s identity and reputation. This Policy applies to licensees, partners, and other authorized users who have received express written permission to use the Mako Marks. Unless you have received prior express written permission from an authorized representative of Mako, you may not use the Mako Marks for any purpose. Any unauthorized use may result in immediate legal action.
General Requirements
Your use of the Mako Marks must: (1) comply with your current agreement with Mako; (2) follow this Policy and our Brand Style Guide (https://docs.makonetworks.com/brand-guidelines/); and (3) adhere to any additional requirements Mako may issue regarding the use of the Mako Marks. You may not use any of the Mako Marks without Mako’s prior written approval. Submit all approval requests to legal@makonetworks.com.
Usage Standards
Mako will provide approved versions of the Mako Marks for your use. You may not modify these logos, including altering colors, proportions, fonts, or adding/removing elements. The Mako Marks must appear standalone with adequate spacing from other visual or textual elements and be displayed on backgrounds that do not interfere with their visibility or legibility.
You may not use the Mako Marks in any manner that:
- Exceeds the scope of authorization Mako has provided you concerning such use.
- Implies any sponsorship, endorsement, or affiliation not expressly authorized by Mako.
- Could damage or diminish Mako’s reputation or goodwill.
- Is likely to cause confusion between Mako and any other entity.
- Incorporates the Mako Marks into your trademarks, service marks, product names, service names, company names, domain names, social media handles, or any other branding element.
Digital and Social Media Usage
You may not register, use, or attempt to register any domain names or social media handles that include any portion of the Mako Marks or confusingly similar variations. This includes any variations using Mako’s name or marks in combination with other terms. Any existing domain names or social media accounts containing Mako Marks must be immediately and permanently deleted or transferred to Mako upon request.
Partner, Licensee, and Logo Requirements
All authorized partners and licensees, such as resellers, distributors, and affiliates must follow the requirements described in this section when using Mako Marks. This includes proper logo usage, as outlined below:
- Strictly comply with all terms of your written agreement with Mako.
- Follow any additional trademark guidelines specified in your agreement.
- Use only approved versions of partner badges or certifications.
- Maintain appropriate clear space around logos equal to the height of the logo mark.
- Use only approved color variations as specified in the Brand Style Guide.
- Do not rotate, distort, add effects to, or modify logos in any way.
- Do not combine logos with other graphical elements or logos.
Ownership and Rights
You acknowledge that all rights to the Mako Marks belong exclusively to Mako. Any goodwill generated through your use of the Mako Marks benefits Mako solely. You hereby assign any rights you may acquire in the Mako Marks to Mako and execute any documents reasonably requested by Mako to perfect or maintain its rights in the Mako Marks.
Quality Standards for Usage
All advertising, educational, and editorial uses of the Mako Marks must:
- Be professionally produced and of high quality.
- Accurately represent Mako’s products and services.
- Comply with all applicable laws and regulations.
- Not imply sponsorship or endorsement without authorization.
No Trademark Bidding
Unless expressly permitted in an agreement between you and Mako, you may not bid on a Mako Mark (or any variant or extension thereof) as a keyword on any search engine or use a Mako Mark (or any variant or extension thereof) in any form of paid advertising including, but not limited to, paid social and display advertisements.
International Usage
This Policy applies worldwide. When using the Mako Marks in countries outside the United States, you must:
- Ensure compliance with local trademark laws and regulations.
- Use appropriate trademark symbols as required by local law.
- Provide translations of trademark notices when necessary.
- Obtain necessary local approvals or registrations.
- Notify Mako of any local requirements or restrictions that may affect trademark usage.
Copyright Protection
Use or reproduction of Mako’s original works of authorship, including designs, content, text, photographs, diagrams, videos, and images displayed on Mako’s website or other documentation, is prohibited without prior written approval from Mako.
Monitoring and Auditing of Trademark Use
Mako reserves the right to monitor and audit the use of its trademarks by all partners, licensees, and authorized users to ensure compliance with this Policy. As part of this process, Mako may request samples of materials using the Mako Marks, review digital presence, or conduct periodic audits. Failure to comply with an audit request may result in the suspension or termination of your usage rights.
Notification of Trademark Misuse
If you become aware of any unauthorized or improper use of the Mako Marks by any third party, please promptly notify Mako at legal@makonetworks.com. This includes any instances of counterfeiting, infringement, or use that could lead to confusion or damage Mako’s reputation.
Termination of Use
Mako reserves the right to terminate or modify permission to use the Mako Marks at any time. Upon termination, you must immediately cease all use of the Mako Marks and destroy any materials containing them. You must provide written certification of compliance within 10 business days of receiving notice.
