Acceptable Use Policy

This Acceptable Use Policy (“AUP“) governs the use of all Mako Networks services and is incorporated into the terms and conditions governing your relationship with Mako Networks. By using any Mako Networks’ services, you acknowledge and agree to comply with this AUP. Users shall immediately report any violations of this AUP to Mako Networks and cooperate with Mako Networks to investigate and remedy such violations.

Prohibited Uses

Users of Mako Networks services (“Mako Services“) (including any device, system, network, account, or infrastructure used in connection with the services) are prohibited from:

  • Violating any applicable laws or regulations, including telecommunications, networking, data protection, privacy, security, export control, sanctions regulations, and cybersecurity requirements at federal, state, and local levels.
  • Using the Mako Services in a manner that could expose Mako Networks or its suppliers to civil or criminal liability or regulatory enforcement.
  • Reselling, sublicensing, assigning, or redistributing the Mako Services without explicit written authorization.
  • Using the Mako Services for high-risk activities where disruption could harm persons or property, including emergency services, medical facilities, critical infrastructure, nuclear facilities, environments requiring fail-safe performance, or environments where malfunction could result in risk of injury, death, or property damage.
  • Transmitting malicious code, including viruses, worms, Trojan horses, malware, spyware, or ransomware.
  • Attempting to bypass or circumvent service limitations, security measures, firewalls, authentication systems, network access controls, or compliance mechanisms.
  • Conducting unauthorized activities that compromise system integrity, including network scanning, penetration testing, security assessments, or deploying automated systems, scripts, or processes that could impact network performance, security, or reliability.
  • Modifying, tampering with, or attempting to access without authorization any Mako Networks equipment, configurations, infrastructure, networks, systems, or resources.

Mako Voice Prohibited Uses

In addition to the prohibited uses above, users of Mako Networks Voice over IP (VoIP) services are prohibited from:

  • Implementing automated systems that interact with Mako Services, including auto-dialers, predictive dialers, or systems that replace human interaction, without explicit authorization.
  • Engaging in fraudulent or deceptive practices, including toll fraud, caller ID spoofing, IP spoofing, header manipulation, impersonation of identity, or misrepresentation of phone numbers or other identifiers.
  • Generating patterns of suspicious call activity, including high volumes of unanswered calls or calls lasting less than twelve seconds.

Enforcement

Mako Networks maintains sole discretion in determining violations of this AUP and reserves the right to:

  • Immediately suspend or terminate Mako Services without prior notice.
  • Monitor and investigate potential violations.
  • Take appropriate technical and legal action against violators.
  • Cooperate with law enforcement investigations when required.
  • Disclose information about violations to affected parties as necessary.
  • Monitor service usage patterns and implement restrictions on excessive or abnormal usage.
  • Set reasonable usage limits or thresholds.
  • Implement traffic management and security measures.

Modifications

Mako Networks reserves the right to modify this AUP at any time by posting an updated version on our website or providing notice through other reasonable means. Continued use of the Mako Services following any modification constitutes acceptance of the updated AUP.

Responsibility for End Users

Customers are responsible for ensuring that all end users, including employees, contractors, and other authorized users, comply with this AUP. Customers must implement appropriate policies and procedures to prevent prohibited uses and promptly address any violations.
